Here are 7 things you should know before hiring your injury lawyer
2) Hire a personal injury lawyer that specializes in your specific type of injuries. Do your homework before signing the retainer agreement. Visit the firm's website and read up on it's history and each lawyer's biographical information. Ask the lawyer for some referrences and ask how much experience they have in handling cases with similar injuries. What settlement awards did they get in those cases?
3) Have a face-to-face meeting with your prospective lawyer. Your personal injury lawyer is going to be your closest advisor during this difficult time. You must feel comfortable and trust your lawyer. The only way you'll get a feel for the lawyer is by having a sit-down to discuss your case. Any good personal injury lawyer will give you an initial consultation free of charge.
4) Hire a lawyer that will take your case on a contingency fee basis. This means that your lawyer won't get paid unless you get paid. He will take his fee out of the money you receive for your injuries. You can expect your lawyer to take about 33% of your final settlement - that's after expenses are taken off the top. Make sure you clearly understand the payment structure before you sign the retainer agreement.

Immigration Reform
The INS is now responsible for many tasks that it never had before, including inspecting travelers who are entering and exiting the United States gates through more than 300 points of entry nationwide. Whether you are coming or going from the United States, you are likely to be passing through an INS worker who is responsible for helping make sure anyone who is wanted by the law is not able to gain entry to the country. Although largely a precaution, it is thought that this will be most helpful in preventing possible threats to national security.

Washington judge suing after store lost trousers taken in for alterations
May 04, 2007 04:30 AM
Lubna Takruri
ASSOCIATED PRESS
WASHINGTON–A missing pair of pants has led to one big suit.
A customer got so steamed when a dry cleaner lost his trousers that he sued for $65 million (U.S.). Two years later, he is still pressing his suit.
The case has demoralized the South Korean immigrant owners and brought demands that the customer – an administrative law judge in Washington – be disbarred and removed from office for pursuing a frivolous and abusive claim.
"They're out a lot of money, but more importantly, incredibly disenchanted with the system," said Chris Manning, lawyer for the owners. "This has destroyed their lives."
The customer, Roy Pearson Jr., who has been representing himself, declined to comment.
According to court documents, the problem began in May 2005 when Pearson became a judge and brought several suits for alterations to Custom Cleaners in Washington. A pair of pants from one suit was missing when he requested it two days later.
Pearson asked the cleaners for the full price of the suit: more than $1,000.
But a week later, the owners said the pants had been found and refused to pay. Pearson said those were not his pants and decided to sue.
Manning said the cleaners have made three settlement offers to Pearson: $3,000, then $4,600, then $12,000.
But Pearson was not satisfied and expanded his calculations beyond one pair of pants. Because he no longer wanted to use his local dry cleaner, he asked in his lawsuit for $15,000 – the cost of renting a car every weekend for 10 years to go to another business.
The bulk of the $65 million demand comes from Pearson's strict interpretation of Washington consumer protection law, which imposes fines of $1,500 per violation, per day. Pearson counted 12 violations over 1,200 days, then multiplied that by three defendants.
Much of Pearson's case rests on two signs Custom Cleaners once had on its walls: "Satisfaction Guaranteed" and "Same Day Service." He claims the signs amount to fraud.
The case is set for trial June 11.
Sherman Joyce, president of the American Tort Reform Association, an organization that fights what it considers abusive lawsuits against small businesses, has asked that Pearson be denied a renewal of his 10-year appointment. The association has also offered to buy Pearson a new suit.
Chief Administrative Judge Tyrone Butler had no comment on Pearson's reappointment prospects.
Melvin Welles, former chief administrative law judge with the National Labour Relations Board, wrote to The Washington Post to say that if he were the judge in the case, he would throw out the lawsuit and order Pearson to pay the dry cleaners for their legal expenses and their mental suffering. He also called for Pearson's ouster and disbarment.
"The manifest absurdity of it is too obvious to require explanation," he wrote.

LGBT teen brutally harassed. Help make her legal case!
Lambda Legal filed a lawsuit on Nancy’s behalf based on a state law that prohibits sexual orientation discrimination in schools. Lambda Legal is fighting a battle against discrimination for Nancy and for other LGBTQ students around the country, and they need our help to win cases like these!
This anti-discrimination case is only one example of the many cases on which Lambda Legal is currently working. Lambda Legal is the oldest and largest national legal organization committed to achieving full recognition of the civil rights of lesbians, gay men, bisexuals, trans gender people and those with HIV through impact litigation, education and public policy work.
In 1996, Lambda Legal won a case similar to Nancy W's. The landmark victory of Nabozny vs. Podlesny created a ripple effect around the country, holding schools nationwide accountable when they fail to protect their students from anti-gay harassment. Without the donations of people like you, these precedent-setting victories would not be possible.
Discrimination in the workplace can be as harmful as discrimination at school. Did you know that only 17 states and the District of Columbia have laws protecting gay and lesbian employees from discrimination, or that only nine states and the District of Columbia prohibit discrimination based on gender identity? Nancy's case brings relief and protection not only to her, it also brings hope to the many LGBT people who are facing harassment at work or school across the country. One case can change thousands of lives. That's impact, and that's what Lambda Legal does.

Debt and credit Lawsuits
Telling the judge that you do not owe the plaintiff any money, or that you owe less than what is claimed, there will have to be a contested hearing called a trial. The judge may set another date for a trial. However, in some counties, particularly in small claims cases, the judge may hold the trial on the first appearance date. Check with the judge's clerk or the court clerk to find out whether you need to be prepared for trial on the first appearance date.
A debtor can tell the court why the creditor should not be able to collect all or some of the money that is being sought. This can be done by presenting a defense or counterclaim or both. A defense is either a set of facts or a legal reason why the plaintiff should not recover the amount being sought. A defense can defeat the creditor's action or tries to reduce the amount of money you need to pay. There are many different types of defenses which are possible in consumer cases. Woman Kills Her Own Children
In the blink of an eye, North America was informed of Susan Smith's tragic loss of her two young boys. No one would have guessed that such a violent crime could have occurred in a small town. Throughout the ordeal , police began to see the flaws in Susan Smith's story. This lead to suspicions, causing the police to make Susan Smith their prime suspect. Days later, Susan Smith confessed to the hideous crime she committed, leaving the nation in disgust. The actions of Susan Smith, which were based on her background and the events in question have left a profound social and legal impact on society's views of violent crimes.
Susan Smith lived what most would consider a normal life up to the time before the event concerning the murder of her two children. The only exceptional incident in her past was the suicide of her father when she was eight years old. Susan met her future spouse David Smith, at the age of nine-teen. The couple later went on to have two children, Michael and Alex. She was described as "well-known and well-liked" by her friends, neighbors and relatives. None of her friends or neighbors could have expected Susan Smith to commit such a horrible crime.
The event took place in a small town in Union, South Carolina. On October 25th Susan Smith explained that she was "heading east on Highway 49 when she stopped at a red light at Monarch Mills about 9:15 p.m., and a man jumped into the passenger seat." She described the man "as a black male in his late 20s to early 30s, wearing a plaid shirt, jeans and a toboggan-type hat." She said that the abductor held her at gun point and told her to drive. She drove northeast of Union for about 4 miles. Then the man suddenly told her to stop the car. Mrs. Smith said she asked if she should pull over, but the man said for her to stop in the middle of the road. She claimed that she begged for the release of her two children, who were still strapped in the back seat, but it was to no avail. The town sent out thousands of volunteers to search through "over five hundred square miles for the children."
The story later went national but there was still no sign of the children or the attacker. The town Sheriff, John Wells, with the help of an FBI computer system went after every lead that came in from psychics, crackpots and well-meaning citizens. Even helicopters with heat seeking devices were used to try and locate the children's bodies. Both Susan and her ex-husband also faced the cameras in an emotional cry for help.
Police and prosecutors played a major role in uncovering holes in Susan Smith's story of the abduction. As days passed Susan's story left too many unanswered questions. "No crimes had been reported in the area that night so why would a suspect be fleeing? Why would he take the children if he only needed a car? If the stop light Susan stopped at uses sensors to detect other cars so as to determine when to flash a green or red light, how could she have stopped at a red light with no other cars around?" Also ,"Susan's description of the abductor was so ordinary that it was useless." "Marc Klass and Jeanne Boylen came to Union to help the police with the investigation yet Susan wanted nothing to do with them. " The incident had so many holes in it that everyone started to get suspicious of the story. The police began to wonder about Susan's innocence even though nothing of the sort was said in public. The police finally called Susan in for questioning and searched her home for fingerprints. She failed a lie detector test and the neighbors began to get suspicious telling the police about a man she was recently seeing. A letter from Tom Fidley (the man she was seeing) was found telling Susan that he wanted to be with her , yet he was not ready for a ready made family. "The pressures were suddenly more than Susan could handle and she broke down under questioning and confessed after nine days."
On November 3rd, she told police the location of the bodies. Divers went to John D Long Lake at 4:15pm on Thursday and they pulled the car from the mud. At 6:45pm it was confirmed that two bodies were found in the back seat. Mrs. Smith was arrested and charged with two counts of murder.
The prosecution in the trial, Prosecutor Thomas Pope, sought whole-heartedly to convict Susan Smith to the full extent of the law in the murder of her two children. "At one point during the trial he asked for the death penalty." On July 22nd, 1995, a jury of nine men and three women swiftly rejected the death penalty after only two and a half hours of deliberation. They decided that the death penalty was not appropriate for a "really disturbed person." When it came to the trial her lawyer tried to argue she had "suffered enough for drowning her two young sons, and that the jury should be lenient." The request fell on deaf ears. Susan's confession led to her sentencing to life in prison. She will be eligible for parole in thirty years.
The actions of Susan Smith will never be forgotten, especially by those who live in Union, South Carolina. The unforgivable misdeeds of Smith have had an enormous impact on this little town which citizen described as "...a God-fearing, law-abiding place." The whole town of Union bonded together to help support Susan and the police during this difficult time. The citizens hung yellow ribbons on their doors as a sign of hope that the two little boys would soon be found. Once Susan admitted to killing her sons the reaction was intense and furious. People replaced their yellow ribbons with black ones for mourning, blue ones for boys and white ones for innocence. Flowers were left near the lake by mourners and many felt the need to hold their children for a while during this time. Susan Smith fooled everyone, even her husband of three years and her family. Once Susan admitted her guilt, anger and hatred rose in the hearts of those who believed in her. Thousands everywhere had no idea how someone could be filled with so much despair as to step so far over the line of right and wrong and murder her own two sons. At Susan's bond hearing hundreds of people showed up to voice their opinions yelling "murder!" and "baby killing bitch" Out of anger also arose ugliness. Some people advocated "stringing her up right in the middle of the courthouse." Many African Americans were also very upset at the fact that Smith labeled the abductor as a black man. "The actions of Susan Smith will never leave the hearts and minds of the citizens in Union who once trusted her and sympathized with her."
This particular case did not cause changes in the law or the legal system. What it did do is awaken the people of the United States and Canada to the reality that evil and deceit lives in our countries. Because of this incident programs have now been opened throughout the United States and Canada to provide support and assistance for troubled families.
The three principles of law could be seen in the case against Susan Smith. "Law as a legal concept" was illustrated in the case through the use of the jury to come out with a just decision concerning Susan Smith. "Law as a legal system" was also seen in the many agencies of our society used to uphold rights. The police and the FBI got to the truth about what really happened, and arrested the person responsible. Finally "law as a set of rules" was shown in this case because the court decided that Susan Smith broke one of the various rules set by society and she must be punished for it.
Susan Smith's actions were based on countless actions throughout her life. Traumatic experiences found in her background inevitably lead to the appalling crime. One thing that is certain is that it left a scar on society, and had an impact on their social and legal views. This research assignment has enriched my understanding of law as a legal concept, law as a legal system and law as a set of rules. It has shown me first hand the use of these three concepts in our world today.

Fighting the Big Boys in Court
You would think microsoft technicians are very knowledgeable but I guess there are good and bad in everything.
I had called microsoft for technical help because I was having issues with my sp2. He informed me he could fix this problem and for me to reboot the computer and once it started booting up to keep pushing f2. Well I did what he told me and ended up ( which i now know as windows bios) he told me where to go so my computer would be faster. I did what he said and all of a sudden my computer crashed. He then told me my time was up and hung up on me. I
Needless to say I called back and told the person what had happened. They ask me for his name and the time i called, which i gave them and they said "i see here he put you were very satisfied" I told her no and i wanted to report this. I got a manager on the phone and after days of him investigation he told me I would be compensated for my aggravation . I said you fried my computer and mother board something better be issued soon. He assured me and about a wk later I received my compensation. A hat and a coffee cup. I was outraged and proceeded to contact my attorney. Well to make a long story short I ended up filing a claim with microsoft.
Well the day of court presented my case and they presented theirs and low and behold I won. Not only did i get compensated for my computer, I also got compensated for the trouble i had been through ( mental anguish)
So yes you can sue a major company and win. Just be honest, tell your side of the story, and above all look the judge in the eyes. LOL.

Racketeering Charges Filed Against Donald Rumsfeld & Monsanto
In an extraordinary joint statement, more than 200 Socialist members of the European Parliament hailed the American election results as "the beginning of the end of a six-year nightmare for the world."
Secretary of Defense Donald Rumsfeld was president of Searle Pharmaceuticals, a company owned by Monsanto... Rumsfeld is believed to have earned around US$12 million from the sale of Searle to Monsanto.
Racketeering charges have been filed against Secretary of Defense, Donald Rumsfeld, Monsanto, NutraSweet Co., the American Diabetes Association and Dr Robert Moser for distributing toxic aspartame, in a class action representing many plaintiffs, filed in the US District Court for the Northern District of California seeking $350 million in damages.
The suit charges the defendants with manufacturing and marketing a deadly neurotoxin unfit for human consumption... US Secretary of Defense, Donald Rumsfeld, is mentioned throughout the lawsuit.
The Bush administration's could be called the Monsanto Cabinet, per Robert Cohen, author of "Milk, The Deadly Poison" which details the horrid politics behind the contamination of our nation's milk and beef supply with bovine growth hormone.
Secretary of Defense Donald Rumsfeld was president of Searle Pharmaceuticals, a company owned by Monsanto. Rumsfeld was also the Secretary of Defense under President Ford.
Rumsfeld is believed to have earned around US$12 million from the sale of Searle to Monsanto.
Attorney General John Ashcroft reportedly received $10,000 for his senatorial campaign from Monsanto in the mid 90s. Ashcroft's contribution from Monsanto was five times that of any other congressional hopeful. Ashcroft, and Sr. Bush Supreme Court appointee Clarence Thomas were instrumental in gaining Food and Drug Administation (FDA) approval for Monsanto's controversial artificial sweetener aspartame, which has been linked to over 200 ailments that include Alzheimer's disease, juvenile diabetes, depression, epileptic seizures, blindness, memory loss, excitability, weight gain, multiple sclerosis and lupus (The Idaho Observer, November, 2000).
[Former] Secretary of Agriculture Ann Veneman was on the board of directors of Calgene Pharmaceutical, another company currently owned by Monsanto.
Secretary of Health Tommy Thompson is the fourth member of the Bush cabinet to have direct ties to Monsanto. The former governor of Wisconsin designated his state as a "biotech zone" for the use of Monsanto's bovine growth hormone even though dairy farmers in his state opposed the designation by a 9-1 ratio. Thompson reportedly received $50,000 from biotech companies during his election campaign.
Bovine growth hormone, which does increase the productivity of dairy cows, has also been linked to many health problems in children and adults (The Idaho Observer, November, 2000) and makes cows sick.
Bovine growth hormone has been outlawed in most countries, but not the U.S.
And as Cohen points out, another player in the Monsanto-studded Cabinet is Rep. Richard Pombo, who will head the Agriculture Subcommittee on Dairy, Livestock and Poultry. Pombo is also a Monsanto boy, having taken campaign money from it while stalling a 1994 bill to make labeling mandatory for milk or milk products containing Bovine Growth Hormones. Pombo helped kill the bill in committee...
Monsanto has proven to be one of the most greedy, ruthless and environmentally irreverent corporations in world history. One cannot serve the interests of Monsanto and serve the interests of people at the same time. ---

Niche Issues Creates More Reason For Legal Protection
There are a number of reasons you may need to take lawsuit action against another party. In some cases, you may have purchased a product with which you are not happy or that has injured you or made you ill. You may have received poor service from a company or individual that has ended up costing you money or has hurt you in some way. You may have taken a trip and been injured or you may just need to make a point through litigation.
For instance, many people have complained about going on cruise ship vacations only to be struck down by what seems to be an illness that is infecting the entire ship or something happens aboard cruise ship and they are unsure about how to seek appropriate compensation. In terms of the mysterious cruise ship illness, in many cases, on ships, this occurs but you are not in any real significant danger, for the most part. In most cases, the cruise ship illness is a gastro-intestinal virus and it includes common annoying symptoms like a low grade fever, nausea, vomiting and diarrhea.
Cruise ships are close quarters and despite their best efforts to ensure that ships are as clean as possible, the seriously infectious Norovirus can still come aboard – on passengers. Noroviruses are usually spread through person to person contact and are typical of people who have had exposure to fecal matter from unwashed food, in untreated water or through person to person contact with people who don’t regularly wash their hands.
In more serious cases of cruise ship negligence, fires have broken out on some cruise ships recently and people have been seriously injured or people have lost a loved one who literally disappears from the ship itself. People also can slip and fall or fall prey to other accidents on board. In any of these instances, if you feel you have been treated unfairly or that you have been injured as a result of your time on a cruise ship, you should seek the advice of an attorney.
Student taking the SAT are another group who are now seeking compensatory damages because of incorrect scoring reports that were mailed out to a huge number of high school students in the fall of 2005. Although the scores have now been adjusted and re-checked, many students may have been adversely affected in their college application process, in any fees they incurred to retake the test or to take SAT prep courses that were unnecessary – not to mention the stress and agony of getting the wrong score! There has been a rash of incorrect standardized test scoring recently and if you have been negatively affected, lost a potential job or have been kept from graduating, you may win damages.
As you can see, there are many situations in which seeking an attorney and filing a lawsuit may be appropriate. If you feel as though your consumer rights have been violated or that you have sustained a personal injury because of another party, you should seek the advice of a qualified attorney to protect your rights and secure any compensation to help you.

Wal-Mart has violated U.S. child labor laws - Say No
This holiday season, join our partner Wake Up Wal-Mart in calling on Wal-Mart to adopt a zero tolerance policy on child labor: http://go.care2.com/e/R2ZR/b9qg/DmWm
A recent investigation by the National Labor Committee revealed children, some only 11 years old, were making Wal-Mart clothes in a Bangladesh factory. The children report being routinely slapped and beaten, forced to work 12 to 14 hours a day, often seven days a week, for wages as low as 6 and a half cents an hour.
Right here in the United States, Wal-Mart's own internal audit found 1,371 instances in which minors worked too late at night, during school hours, or too many hours in a day. It also found 60,767 instances of workers missing breaks and 15,705 instances where employees were forced to work and miss meal times.
Despite all of this, Wal-Mart refuses to adopt a zero tolerance policy on child labor! Our children deserve better from Wal-Mart. This holiday season, tell Wal-Mart to adopt a zero tolerance policy on child labor.

Take Action against the FCC - Help Save The Net
Martin is forcing one commissioner, Robert McDowell, to overlook a conflict of interest and rubber stamp the AT&T merger without safeguards for Net Neutrality -- the longstanding principle that prevents Internet providers from discriminating between Web sites.
This move could undermine basic freedoms for all Internet users. Together, we can stop Martin:
Stop Martin. Act Now to Save Net Neutrality
Chairman Martin is racing to deliver special favors to AT&T before the incoming Congress can provide oversight. Commissioner McDowell rightly "recused" his vote on the merger because he had prior business ties affected by the deal. That left the FCC in a 2-2 tie.
Rather than negotiate with commissioners in good faith, AT&T and Chairman Martin have resorted to strong-arm tactics to force McDowell to violate his ethical standards and vote for the merger.
Stop Martin. Act Now to Save Net Neutrality
Congress has begun to respond to Martin's outrageous behavior. Incoming House leaders John Dingell (D-Mich.) and Edward Markey (D-Mass.) sent a letter to Martin Tuesday demanding that the merger be handled "without compromising the ethical standards of the independent agency or the individual Commissioners involved."
This objection was echoed in the Senate by incoming Commerce Committee Chairman Daniel Inouye. He wrote to Martin: "I hope you will reconsider your decision to waive the ethical rules presently precluding Commissioner McDowell's participation and return to serious negotiations with your colleagues at the Commission. These rules and the rules of professional responsibility in general exist for a reason and should not be tossed away lightly."
We agree. To stop this unethical abuse of power, we need to make sure other members of Congress know about Martin's action and put a stop to it. Sign this letter to Congress today. Your comments will also be sent to the FCC:
Stop Martin. Act Now to Save Net Neutrality
Don't let Chairman Martin skirt accountability and sell out Internet freedom. Take action now.
Hugs & Kisses
